Fenton T. Erwin, Jr.

Fenton is an experienced and savvy trial attorney, having tried more than 100 jury cases to verdict. In addition, he has excelled in Bench Trials before Judges and in Arbitration proceedings before individual Arbitrators and panels of 3 Arbitrators.

He has been active in Appellate Practice and several of his cases have expanded the Jurisprudence of the State.

Fenton is a recipient of the highly coveted Evelyn M. Coman Award established in 2002 to recognize a North Carolina attorney who, through personal achievement, has made a significant contribution in the field of construction law while upholding the highest ideals of the legal profession. Since its inception in 2002, only 9 attorneys in this state have been chosen for this Award.

Fenton has represented clients in cases in the United States Supreme Court, the Fourth Circuit Court of Appeals, the Supreme Court of North Carolina, and all other North Carolina State and Federal Courts.

Clients find in Fenton the experience to know when to be aggressive and assertive and when to be calm and collected to present the clients’ position in the most effective way to achieve the clients’ objectives.

His opinions are often sought by other attorneys on practices and procedures in construction law and he is a frequent speaker on trial practice and construction law issues for Construction Trade Associations and Bar Association Continuing Legal Education programs for attorneys.

His early law practice in transactional real estate matters coupled with his extensive trial practice are sought after by both clients and attorneys. Having established a real estate litigation practice, he is frequently called upon to clear title to valuable tracts of real estate.

For years Fenton has carried an AV Preeminent Martindale Hubbell Peer Review Rating and is frequently voted to the Business North Carolina’s Legal Elite.

He is a board certified Mediator and is often asked to serve as a Mediator or an Arbitrator to resolve legal disputes.

Fenton has served in leadership positions in each church in which he has been a member.
