Overview

Our attorneys have vast experience representing financial institutions, farm credit lending groups and other third party lenders  in workouts, receiverships, and foreclosure matters involving distressed property.  We proactively review loan documents to ensure liens are perfected, cross-collateralized and/or cross-defaulted if multiple loans are involved.  Further our attorneys are prepared to engage in discussions and prepare transactional documentation involving loan modifications,  refinancing, forbearance agreements, confessions of judgment or surrender agreements.   Our group is unique in that our lawyers also have experience in real estate litigation involving foreclosures, priority litigation between competing lenders, and lender liability suits arising out of foreclosure matters.   In the past we have been involved in distress property matters involving:
