Nexsen Pruet's David Dubberly spoke to South Carolina Lawyers Weekly for an article entitled "Small businesses in S.C. must verify work status starting July 1."
Fred Horlbeck wrote about the final phase of the S.C. Illegal Immigration Reform Act, which mandates that all employers verifying work authorization of new hires. Before July 1st, only employers with more than 100 employees were required to have verification.
Dubberly told the paper that auditors are "pretty unforgiving if an employer does the e-verification late. Almost every citation I've seen they will cite the employer for $850 or something like that. They will cite them for close to $1,000 even if it's an innocent violation of the law." Dubberly added that, under the law, repeated violations could result in regulators shutting down a business.
