On February 17, 2009, President Barack Obama signed the American Recovery and Reinvestment Tax Act. One key provision in the Stimulus Act provides certain "assistance eligible individuals" with Federal assistance in paying for COBRA continuation under an employer's group medical coverage. The new subsidy provides assistance eligible individuals a subsidy of up to 65% of the required COBRA premium for up to 9 months of extended coverage. These new rules will require employers to change COBRA administrative practices, COBRA notices, plan documents, and agreements with plan providers. Employers should act soon to comply with new notice requirements imposed by the Stimulus Act and protect against future medical claims liability.
