Nexsen Pruet Successfully Defends SC Hospitals in Class Action

On July 21, 2000, Grady McMehan, an attorney in Rock Hill, brought a class action lawsuit against Smart Corporation and thirty-eight South Carolina hospitals, alleging that Smart Corporation and the defendant hospitals conspired to violate antitrust laws related to the copying of medical records. The South Carolina Hospital Association organized a joint defense group comprised of twenty-five hospitals, and selected the law firm of Nexsen Pruet Jacobs and Pollard, LLC, to coordinate and lead the defense of the hospitals.

On June 7, 2001, Circuit Court Judge Henry McKellar granted the defendant's Motion to Dismiss the case against Smart and the defendant hospitals. According to the lead attorney for the joint hospital defense group, Marguerite Willis, with Nexsen Pruet Jacobs & Pollard, LLC, "This is an important victory for the hospitals because of the potential impact this case could have had on the way hospitals deal with the copying of medical records. We are very pleased with this prompt dismissal as we felt that this case lacked merit from the beginning."
