"Ludwig prosecutor wants judge to reconsider probation sentence"

The November 19th edition of The Greenville News featured an article entitled "Ludwig prosecutor wants judge to reconsider probation sentence."  Nexsen Pruet attorney Billy Wilkins defended John Ludwig in the case.

Initially, 13th Circuit Solicitor Bob Ariail filed a murder charge in connection with the deadly car accident in April.  But, Arial dropped that charge and instead asked the court for the maximum of ten years in prison on a reckless homicide charge.  But, the judge in the case sentenced Ludwig to three years probation and 500 hours of community service.

The paper reports that Solicitor Ariail "cited public outcry" in filing the motion for reconsideration.  Wilkins told The Greenville News that comparisons drawn between this case and other reckless homicide cases are flawed.

“Solicitor Ariail has vigorously represented the interests of the state throughout.  This is a good example of how hard he is fighting to achieve the result he thinks is right. I just happen to have a very different view of what a just result is,” said Wilkins.
