"GOP chair moves to block Democrats from voting in Republican primaries"

Greenville    The Greenville News / greenvilleonline.com    April 18, 2009

The April 18th edition of The Greenville News reports on a recently filed lawsuit that claims the South Carolina State Election Commission is violating the constitutional rights of the chairman of the Greenville County Republican Party.

The suit cites a 2007 federal appeals court ruling written by Nexsen Pruet member Billy Wilkins while he was chief judge of the U.S. Fourth Circuit Court of Appeals.

The paper reports "Wilkins held that Virginia’s open-primary law wasn’t unconstitutional on its face because it allowed political parties to pick candidates in ways other than by a state-funded, open primary."

But, The Greenville News reports that according to the suit, South Carolina election law is different because a "super majority" is required for political parties to nominate a candidates during a convention.
