John R. Perkins, Jr. practices in the firm's Intellectual Property, Litigation, Computer, Internet and Technology, Appellate Advocacy, Startups - Innovation Team, and Alternative Energy groups. He focuses on all aspects of intellectual property law, with particular emphasis on complex litigation and alternative energy.
Perkins counsels businesses large and small regarding identification and protection of their intellectual property. Nexsen Pruet's commitment to alternative energy development led John and others at the firm to establish the Alternative Energy Group to better meet the needs of the burgeoning Alternative and Renewable Energy market nationwide.
He handles disputes regarding patents, trademarks, copyrights, trade secrets, and antitrust violations. In addition to his litigation experience, he also handles transactional matters, including the acquisition of patent rights and opinion work relating to patent validity, enforceability and infringement. His technical proficiency spans a variety of disciplines in the electrical and mechanical arts, including wind energy, solar energy, avionics, fiber optics, power systems, semiconductors, software, hardware, and telecommunications. Perkins holds a B.S. in Electrical Engineering from Clemson University. He was an Engineer and Team Leader at Duke Energy Corporation for ten years.
Perkins earned his law degree from George Mason University School of Law, with honors. While in law school, he was a member of the Federal Circuit Bar Journal, Delta Theta Phi and the Intellectual Property Law Society. He received top honors in the 2001 GMUSL Upper-Class Moot Court competition as well as First Place in the 2002 Nathan Burkan Memorial Writing Competition. After law school, Perkins served as law clerk for The Honorable Pauline Newman of the United States Court of Appeals for the Federal Circuit. Following the clerkship, he worked in the Intellectual Property and Complex Litigation Groups of a major international law firm in Washington, D.C., where he focused on complex litigation with an emphasis on intellectual property litigation.
He is a frequent speaker and author on issues related to intellectual property and alternative energy.

- Garcia v. SCE&G. District of South Carolina. Obtained summery judgment of non-infringement in defense of Fortune 500 company.
- SubAir Systems v. Precision Small Engine. District of South Carolina. Obtained favorable settlement in patent infringement suit against alleged infringer of golf-related patent.
- Van Romer v. Interstate Products. District of South Carolina. Former counsel in ongoing patent infringement suit against alleged infringer of flexible containment berm patent.
- Elementis v. USPTO. Eastern District of Virginia and the U.S. Court of Appeals for the Federal Circuit. Successfully sued U.S. Patent and Trademark Office to obtain requested rule change that now allows patentee’s preliminary argument in ex parte reexamination procedure.
- Orion IP, LLC v. BMW et al. Eastern District of Texas. Obtained favorable settlement in multi-case, multi-defendant patent infringement suit.
- Heidelberg v. Man Roland. District of New Hampshire. Successfully defended foreign printing machinery manufacturer in patent infringement and antitrust suit brought against primary competitor.
- Defended major airline in an antitrust lawsuit brought before the European Commission and U.S. Dept. of Justice for price-fixing.
- Xactware v. Symbility. District of Utah. Successfully defended software manufacturer against charges of patent infringement and obtained a dismissal of declaratory judgment.
State Litigation
- Represented retailer in pursuing breach of contract action against reseller in Minnesota.
- Defended retailer in breach of contract actions in South Carolina, Florida, and Oregon.
- Defended real estate company against Oregon realtor in trademark infringement action.
- Defended golf pro against Washington state copyright holding company in copyright infringement action.
