  • Section 363 Sales
    The sale of assets in a bankruptcy under the 11 U.S.C. § 363 sale provisions has become an often beneficial and desirable means for the realization of value of property in situations involving a distressed owner, or where asserted liens and interests in the property would cause an elongated sale process outside of bankruptcy, or where the purchaser seeks protection from the potential claims of creditors of the property owner. Unsettled, or Unsettling, Law? A Review of Bankruptcy Jurisdiction Following Stern v. Marshall

  • Mr. Mendoza was a co-presenter with George Scott at a South Carolina Bankruptcy Law Association meeting in November, 2011.
  • Mr. Mendoza, George Scott and Judge John T. Laney, III, Chief Judge of the U.S. Bankruptcy Court for the Middle District of Georgia also discussed Stern v. Marshall at a Consumer and Business Bankruptcy Seminar in November, 2011.  The seminar was co-sponsored by the Bankruptcy Law Section of the State Bar of Georgia and the Georgia Institute of Continuing Legal Education.
